SCIenergy and Serious Energy Settle Trade Secrets Lawsuit
San Francisco, CA – March 20, 2012 – SCIenergy, Inc., a global leader in providing cloud-based energy management solutions for building owners and operators today announced it has settled its lawsuit against Serious Energy, Inc. filed against the company and two former SCIenergy executives
on July 26, 2011 in Cobb County (Georgia) Superior Court.
The suit alleged misappropriation of SCIenergy trade secrets, interference with contracts, aiding and abetting breach of fiduciary duty and other claims and sought an injunction prohibiting them from using or disclosing SCIenergy trade secrets, and soliciting or hiring SCIenergy employees. The settlement with Serious Energy includes a dismissal of all claims filed by SCIenergy, and agreement by Serious Energy not to use or disclose SCIenergy’s trade secrets, and payment of an undisclosed sum by Serious Energy to SCIenergy. The settlement does not include any admission by Serious Energy of any wrongdoing or liability. Additional terms of this settlement are confidential. SCIenergy previously settled separate claims against the two former SCIenergy executives, John Pitcher and Chip Pieper, in return for separate payments by the individuals to SCIenergy, agreements not to use or disclose SCIenergy’s trade secrets and for Mr. Pitcher a non-compete through July 15, 2012.
